B | 另外，根据《中华人民共和国刑法》第二百九十一条的规定，编造虚假的险情、疫情、灾情、警情，或者在信息网络或者其他媒体上传播，或者明知是上述虚假信息，故意在信息网络或者其他媒体上传播，严重扰乱社会秩序的，可以被处以三年以下有期徒刑、拘役或者管制；造成严重后果的，处三年以上七年以下有期徒刑。谭敏涛分析，违法行为人散布地震谣言，到底是给予行政处罚还是刑事拘留，取决于是否严重扰乱社会秩序，是否造成了公共秩序紊乱。
C | 如果仅仅是散布谣言，社会公众并没有因此害怕，也没有造成社会恐慌，那么这属于行政违法行为，公安机关可以给予行政处罚。
